The Philippines does not fit the region's worldwide-income shorthand. A foreign national's category, residence facts, whether they are engaged in trade or business and where services are physically performed must be separated before tax scope can be understood.

How does personal tax work in the Philippines?

Resident aliens are generally taxed only on Philippine-source income. Nonresident aliens are also taxed on Philippine-source income, but the method and rates differ depending on whether they are engaged in trade or business; a nonresident alien present for more than 180 days in a calendar year is deemed engaged in trade or business. Services performed in the Philippines are Philippine-source.

Destination residence

Resident-alien status is fact-based and not defined by one universal day threshold. The separate more-than-180-day rule deems a nonresident alien to be engaged in trade or business; it should not be mislabeled as the residence test.

Income scope

A resident alien is taxed on income from sources within the Philippines. Nonresident aliens are likewise within the Philippine-source net, with different treatment for those engaged and not engaged in trade or business.

Work location

The Tax Code sources compensation for labour or personal services to the place where the services are performed. Work from a Philippine home can therefore be Philippine-source even if the employer, client and bank account are overseas.

Return and records

Calendar-year individual system. Filing and withholding depend on classification, income and whether tax was correctly withheld; an annual return is generally due by 15 April unless an exception applies. Use current BIR forms and e-filing instructions.

Personal services performed in the Philippines are Philippine-source. An overseas contract or bank account does not move the work.

Gross versus net

Classification can change whether income is taxed on a net progressive basis or a gross final basis. Confirm status before estimating liability.

Tax questions for families moving to the Philippines

Does a visa make me tax resident in the Philippines?

Not by itself. Immigration status and tax residence are separate legal tests. Days, homes, intention and other facts can matter under domestic law; a treaty may then resolve dual residence for treaty purposes without erasing local registration or filing duties.

Can I avoid tax in the Philippines by being paid into a UK account?

Do not assume so. Employment and service income is often sourced where the work is physically performed, while some systems also examine receipt or remittance. Payment location, employer location and tax source are different questions.

Does a double-tax treaty mean I pay no tax?

No. A treaty allocates taxing rights and provides relief from qualifying double taxation. Relief may be an exemption, reduced withholding rate or credit, and usually requires the right evidence and claims in the right return.

Should spouses be analysed together?

Plan as a household but analyse each person. Days, work, income ownership, company roles, pensions and investment accounts can differ. Married-couple filing or relief rules also vary by country.

What records should we keep from day one?

Keep a day log, passports and travel confirmations, visa and home documents, contracts, payslips, invoices, bank and remittance records, tax paid certificates, residence certificates and copies of filed returns. Retain the evidence behind any treaty position.

Is this guide personal tax advice?

Are resident aliens taxed on worldwide income?

No. Section 23 of the Philippine Tax Code generally taxes a resident alien only on income from sources within the Philippines. That makes the source analysis—especially where services are performed—critical.

Does 181 days automatically make me a resident alien?

Not under the wording of the more-than-180-day rule. It deems a nonresident alien to be engaged in trade or business. Resident-alien status itself is a separate fact-based classification.

Is salary from a UK employer Philippine-source?

Compensation for services physically performed in the Philippines is Philippine-source under section 42, regardless of the payer's location. Employer, withholding, treaty and immigration consequences still require separate review.

When is the annual Philippine return due?

For calendar-year individuals the general annual deadline is 15 April, but withholding-only exceptions, classification and current BIR rules affect whether and how a return is filed. Confirm the current form and electronic route.
