Can foreigners buy property in Bali?
Bali property is often marketed with the English words freehold and leasehold, but the legal right is created by Indonesian land law—not the brochure. Families need to identify the certificate, holder, permitted use, remaining term and registration path before comparing homes or sending a reservation payment.

The short answer
What can a foreign buyer actually hold?
A foreign individual cannot hold Hak Milik, Indonesia's strongest land ownership right. A foreigner with the required immigration document may be able to hold a qualifying home under Hak Pakai or an eligible apartment right, subject to the land, property category, location and current price and area limits. A private lease can provide contractual use for an agreed term, but it is not Hak Milik and should not be described as ownership of the land.
Ownership map
Separate the land, home and contract
The word property can hide several different rights. Identify which right will be registered, which party holds it and how long it lasts.
A qualifying Hak Pakai home
Government Regulation 18/2021 permits a foreigner with the required immigration document to hold qualifying residential property through Hak Pakai arrangements. The certificate, underlying land, permitted category and current local limits must fit the rule.
An eligible apartment unit
Foreign ownership of a qualifying strata unit can be possible on the land-right categories and within the zones permitted by current law. Verify the unit certificate, underlying land, developer handover and current minimum-price rule.
Hak Milik in a foreign name
Only Indonesian citizens may hold Hak Milik. A sale or arrangement intended directly or indirectly to transfer Hak Milik to a foreigner can be void, with severe consequences for the land and money paid.
A private lease
A lease may give use of land and buildings for a defined term. Its protection depends on the owner, certificate, agreement, registration or noting where available, succession and what happens if the land is sold or encumbered.
Do not treat these as foreign ownership
- Hak Milik land through a local nominee who holds it only for the foreign buyer
- A villa as legal freehold merely because the marketing or English contract uses that word
- Residential use or short-term rental permission merely because a building exists
- A visa or residence right automatically through an ordinary home or lease purchase
Long leases
A lease is a contract; Hak Pakai is a registered land right
Bali marketing often calls both arrangements 'leasehold', but they are not interchangeable. A private lease rests on the agreement with the registered landholder. Hak Pakai is a land right registered under Indonesian law and can have a statutory term, extension and renewal route. For state or management-right land, PP 18/2021 generally provides Hak Pakai for up to 30 years, extendable by up to 20 years and renewable for up to 30 years; the actual certificate and grant control the answer.
Check title and authority
Verify the Hak Milik or other underlying certificate, owner, spouse consent, boundaries, mortgages, disputes, access and the right to grant the proposed use.
Define the usable term
Record commencement, possession, building ownership, permitted use, taxes, maintenance, assignment, subletting, sale and default—not just an end date.
Do not assume an extension
Specify who must grant it, when, at what price and under what title. A future option is not the same as years already registered or paid for.
Questions the lease must answer
- Is this a private lease or registered Hak Pakai?
- How much of the stated term remains on the current certificate or contract?
- Can the right be assigned, inherited or mortgaged, and with whose consent?
- Who owns the building and improvements at expiry?
Companies, nominees and other structures
A structure must be lawful in substance, not just on paper
Registration documents show that an entity or agreement exists. They do not prove that it may lawfully be used to give a foreign buyer the benefit of restricted land.
Indonesian nominee for Hak Milik
Do not pay an Indonesian citizen to hold Hak Milik on your behalf while side agreements try to recreate foreign ownership. Article 26(2) of the Basic Agrarian Law makes direct or indirect transfers of Hak Milik to foreigners void and says payments received cannot be reclaimed under that provision.
PT PMA foreign-investment company
A properly established foreign-investment company can hold land rights appropriate to a genuine licensed business, commonly HGB or Hak Pakai depending on the land and activity. It brings investment, licensing, reporting, tax, staffing and substance duties; it is not a paper wrapper for a private family villa.
Private long lease
A well-drafted lease can support long occupation, but it remains a contract with the landholder. Check title, registration options, mortgage priority, sale, inheritance, renewal price, building ownership and remedies with an independent Indonesian adviser.
Independent due diligence
Check the right before judging the home
Use an independent Indonesian advocate and the appropriate land deed official or notary for their proper roles. The seller's notary, a photographed certificate or a company incorporated through OSS does not independently verify the whole property proposition.
1 Verify the certificate at BPN
Check the original certificate, registered holder, right type, expiry, boundaries, encumbrances, blocks and disputes with the responsible land office. Match the legal parcel to a survey and the site.
2 Confirm planning and use
Check the current spatial plan, zoning, coastal or river setbacks, access and whether the intended residential or rental activity is permitted. A building in place is not proof of lawful use.
3 Check building approvals
Verify the applicable PBG building approval, approved plans and SLF fitness certificate, plus utilities, wastewater, fire, pool and access arrangements. Check whether completed work matches them.
4 Verify every consenting party
Check seller identity, marital-property consent, inheritance, company authority, tax number and beneficial parties. Confirm the payment account independently.
5 Inspect the home and land
Commission independent structural, services, drainage, retaining-wall, damp, termite, boundary and access checks suited to the site and season.
6 Test the life of the right
Model sale, owner death, mortgage enforcement, family death or separation, visa change, assignment, extension and expiry. Put every essential protection in the signed documents.
Document reality check
Know what each document does—and does not—prove
Review originals or authority-verified records. A document can be genuine and still fail to answer a different legal or technical question.
| Document | What it can show | What it does not settle |
|---|---|---|
| BPN land certificate and search | The recorded land right, holder, parcel, term and registered burdens at the time checked | That zoning, buildings, access or a private side agreement are lawful |
| PBG and approved plans | The building work authorised by the relevant authority | That the finished villa matches the approval or has an SLF for use |
| SLF fitness certificate | The building was certified fit for use on the stated basis | Future condition, title or permission for every commercial rental activity |
| PT PMA and NIB records | The company and registered business identity | That the land use fits its licensed activity or the company is a valid private-home shortcut |
Reservations and deposits
Keep the money behind clear conditions
Urgency is not evidence. The payment document should preserve enough time and leverage to complete the checks that matter.
Do not reserve an undefined right
The reservation should identify the parcel, certificate, villa or unit, legal right, term, price and contracting party—not only a project name and map pin.
Make due diligence a refund condition
Write a full refund if title, zoning, access, PBG/SLF, seller authority, survey, foreign eligibility, tax or final contract checks are unsatisfactory by a stated date.
Control the money route
Use a documented stakeholder or payment arrangement advised by your own professional. Do not send funds to an agent, nominee or changed account based only on chat messages.
Taxes and transaction costs
Ask for a property-specific completion statement
Indonesian property costs depend on whether the deal is a transfer of a land right, a lease, a new developer sale or a company transaction and on local taxable values. Obtain a written completion statement that identifies the legal payer, contract allocation and calculation base for each amount.
BPHTB acquisition duty
- Usual position
- Buyer or recipient of the qualifying right
- Verify for this deal
- Current local rate, taxable acquisition value, non-taxable threshold and whether the transaction creates a charge
Final income tax on transfer
- Usual position
- Seller-side tax; the standard rate is commonly 2.5% of gross transfer value
- Verify for this deal
- Current national rate, transaction category, value and evidence of payment before deed completion
VAT or developer taxes
- Usual position
- Can arise on qualifying primary/developer sales
- Verify for this deal
- Seller's taxable status, invoice, current effective VAT treatment and any luxury-goods tax; do not assume it is included
PPAT, notary and registration
- Usual position
- Negotiated or allocated in documents
- Verify for this deal
- Scope, professional role, deed, searches, certificate processing, translations and official receipts
Lease and ongoing charges
- Usual position
- Depends on contract and local position
- Verify for this deal
- Rent withholding or other tax treatment, PBB land/building tax, banjar or estate charges, utilities, insurance and extension price
Inheritance and family change
Plan for the right to pass—not just the keys
Ownership eligibility, contract succession and estate administration can produce different answers. Resolve them while everyone can still sign the necessary documents.
Inherited Hak Milik cannot normally be retained
A foreigner who receives Hak Milik through intestate inheritance must release or transfer it within one year under article 21(3) of the Basic Agrarian Law. Do not build an estate plan around permanent retention.
Qualifying foreign residential rights may pass
PP 18/2021 allows the relevant foreign-owned residence to pass to an heir, but a foreign heir must hold the required immigration document. The right, term and eligibility still need checking.
Lease succession depends on the documents
A contractual lease, building ownership and extension promise should expressly address death, estate administration, assignment and beneficiaries. Coordinate Indonesian advice with wills and succession rules elsewhere.
Off-plan property
Research what must exist at handover
An artist's impression cannot confirm land rights, planning, construction, completion or the legal document you will eventually receive.
Land and project permissions
Verify the developer's right to the land, certificate, encumbrances, zoning, PBG, environmental and business permissions, utilities and access before treating marketing as a buildable project.
What will be handed over
Define the completed building, drawings, specification, furniture, shared areas, access, meters, certificate or lease, PBG/SLF evidence and defect standard.
Construction-linked payments
Use independently verified milestones, inspection rights, a completion and long-stop date, variation controls and a clear consequence if work or documents are late.
Operation is a separate permission
If short-term rental is part of the pitch, verify zoning, accommodation licensing, company activity, tax, management and neighbour or estate rules separately. Do not price the family decision around a projected return.
Common sales claims
Turn the claim into a checkable question
A confident sentence is useful only when the title, law, authority and contract give the same answer.
“The nominee structure gives you safe freehold.”
A foreigner cannot hold Hak Milik through an Indonesian nominee. Side agreements do not turn a prohibited indirect transfer into lawful foreign ownership.
“Leasehold and Hak Pakai are basically the same.”
A lease is contractual use; Hak Pakai is a recognised land right. Ask which will be registered, on what underlying land and for which remaining term.
“The notary has checked everything.”
Ask who the professional acts for and what the written scope covers. Title, zoning, access, building, survey, company, tax and contract checks are distinct tasks.
“The villa already operates, so rentals are legal.”
Existing activity is not permission. Verify the location, building, accommodation/business licensing, tax and management rules for the exact use.
“An extension is automatic at today's land price.”
An extension needs a legally effective mechanism, a willing authorised party and a workable price formula. Test the clause against sale, death and dispute.
Research from abroad
Prepare the decision before a viewing creates pressure
You can define the family's goal, appoint independent help and collect most of the legal references before visiting a property.
Choose occupation before structure
Decide whether the family needs a flexible rental, private lease or qualifying registered right. Do not let a marketed structure create the goal.
Appoint your own advisers
Use an independent Indonesian advocate, tax adviser when material and property surveyor. Clarify the separate role of any notary or PPAT.
Map the exact parcel
Collect the certificate reference, coordinates, survey, road access, zoning and building documents before travelling or paying.
Stress-test the family plan
Ask what happens if the visa changes, the owner dies, the company closes, the home cannot be rented, the build is late or the family needs to leave.
Save these questions
Questions to take to the lawyer, seller and authority
Ask for answers tied to the exact parcel, unit, certificate, parties and contract. General reassurance about what foreigners “usually do” is not enough.

Common questions
Questions about foreign property rights in Bali
Can foreigners own land in Bali?
A foreign individual cannot hold Hak Milik. A qualifying foreigner may be able to hold a residence through Hak Pakai or an eligible apartment right under current rules. The certificate, immigration document, property category, location and limits all need checking.
What is the difference between Hak Milik and Hak Pakai?
Hak Milik is Indonesia's strongest land right and is restricted to Indonesian citizens and certain designated entities. Hak Pakai is a right to use land that can be granted to eligible foreigners for a term and under conditions. It should not be translated simply as foreign freehold.
Can I buy Bali property through a nominee?
Do not use an Indonesian person to hold Hak Milik for you while side agreements attempt to give you the real benefit. Article 26(2) targets direct and indirect transfers to foreigners and provides that a prohibited transfer is void, with serious consequences for the land and payments.
Can a PT PMA own a Bali villa?
A genuine foreign-investment company may hold appropriate land rights for its licensed business, subject to investment, zoning, licensing, tax and reporting rules. It is not an automatic route for a private family home or a way to ignore Hak Milik restrictions.
How long can a Bali property lease last?
A private lease term is set by a valid contract and the landholder's authority; many marketed terms are commercial conventions rather than one universal statutory entitlement. A registered Hak Pakai has a different statutory term and extension framework. Check which right is offered and how much remains.
What is the minimum price for a foreign buyer in Bali?
The ATR/BPN ministerial decision used at this review sets Bali minimums of IDR 5 billion for a landed home and IDR 2 billion for an apartment unit, alongside other conditions. Thresholds can change and not every property above them qualifies, so verify the current rule with BPN before committing.
Does buying a villa give me a Bali visa?
No automatic immigration status follows from an ordinary purchase or lease. The property right and any visa or residence route have separate eligibility, document and continuation rules.
What happens if a foreigner inherits Indonesian land?
A foreigner who inherits Hak Milik without a will must release or transfer it within one year. A qualifying foreign residential right may pass under PP 18/2021 if a foreign heir has the required immigration document. Obtain advice for the exact right and estate.
How do I check an off-plan Bali villa?
Verify the land right and holder, mortgages, zoning, access, PBG and future SLF, developer authority, construction specification, milestones, handover documents and refund remedies. Short-term rental permission must be checked separately from permission to build or occupy.
