🇲🇾 Malaysia · employment and family status
Work permits and working in Malaysia
Malaysia's pass names are easy to blur together, but the practical distinction matters: an Employment Pass supports work for the named Malaysian organisation, a Professional Visit Pass supports defined temporary services, and remote-work or dependant status does not create open access to the local labour market.

The short answer
What permission does a family need to arrange?
A Malaysian employer normally applies for the Employment Pass through its authorised route; the individual cannot file it alone. From 1 June 2026, revised salary bands begin at RM5,000 a month and affect category and possible duration. A dependant spouse who wants a local job must obtain their own Employment Pass.
Four separate checks
A residence document is only the first layer
Work through these in order for each adult. A positive answer at one level does not fill a gap at the next.
Employer-sponsored work
How the usual local-employment route works
The employer should own the process, explain it clearly and give the worker copies of every approval.
- 01
Employer
Check the company and position
The hiring organisation confirms its ESD or sector route, position approval, salary category and any approving-agency or regulator support.
- 02
Employer-led
Prepare the complete application
The company files through its account with the contract, role, salary and required corporate evidence; the worker supplies identity, qualifications and experience documents.
- 03
Employer + worker
Coordinate entry and endorsement
Follow the approval letter, Visa with Reference where applicable, entry and ePASS endorsement sequence given for the approved case.
- 04
Worker
Work only for the named company
An Employment Pass is tied to its approved organisation. A change of company requires a new application rather than an informal transfer.
Match permission to the real activity
Six working arrangements families often ask about
Job titles alone are not enough. The employer, clients, place of work and day-to-day duties all affect the answer.
Employment Pass
Job with a Malaysian organisation
The employer applies; category and possible duration depend on the current salary policy and approval. The pass is not portable between companies.
Professional Visit Pass may fit
Temporary services from an overseas company
A PVP can support qualifying temporary services or training on behalf of an overseas company for the named Malaysian company, generally without dependant eligibility.
Check DE Rantau eligibility
Remote job or overseas clients
DE Rantau is designed for qualifying foreign digital nomads. It is not a substitute for an Employment Pass with a Malaysian employer.
Do not assume nomad status covers it
Freelance or consulting for Malaysian clients
Local clients, delivery in Malaysia and business presence can change the immigration, tax and registration position.
Own Employment Pass required
Dependant spouse taking a job
ESD says a Dependant Pass holder who wants to work must apply for an Employment Pass through the hiring company and surrender or shorten the dependant status.
Sector endorsement may be required
Regulated profession
Healthcare, education and other regulated roles can require a practising certificate or regulator endorsement in addition to immigration approval.
Spouses and dependants
Living together does not mean sharing work permission
The current ESD page is direct: a Dependant Pass holder who wants to work must apply for an Employment Pass. The hiring company files it, and the dependant status must be surrendered or shortened because a person cannot simply hold both as parallel permissions.
Plan it early: Model the household around two separate sponsors if both adults plan local employment. Check how a delayed or refused second Employment Pass affects the family's housing, school and income plan.
Working for an overseas employer
Remote work still needs a legal route
DE Rantau can support qualifying foreign remote workers and freelancers under MDEC's current programme, while a Professional Visit Pass covers specified temporary services on behalf of an overseas company. These are different from local employment. Work performed from Malaysia can still require personal tax and employer-compliance analysis even when salary is paid abroad.
What to prepare
Keep the overseas employment or client contracts, income evidence and a day-by-day work record. Obtain written confirmation of what the pass allows and have the overseas employer assess Malaysian payroll, tax and corporate-presence risk.
Self-employment and business activity
Owning a business and working in it are different questions
Company ownership, directorship, active work and immigration status must be checked separately. Registering a company with SSM does not itself give the shareholder permission to work in Malaysia or serve Malaysian clients under any visa.
- Permitted foreign ownership and paid-up capital for the activity
- SSM registration and sector or local-authority licences
- Employment Pass or other permission for the individual's actual duties
- Malaysian payroll, tax registration and invoicing treatment
- Whether the activity is in Peninsular Malaysia, Sabah or Sarawak, which have distinct immigration considerations
Regulated work
Check professional licensing before accepting the role
The revised Employment Pass FAQ says applications requiring a temporary practising certificate or regulatory permit remain subject to endorsement by the relevant regulator, including examples in healthcare and education.
Name the Malaysian professional or sector regulator
Check recognition of the overseas qualification
Confirm whether a temporary practising certificate is available
Allow time for regulator endorsement before the pass decision
Keep licence renewal and Employment Pass dates on one calendar
Employer, payroll and tax
What a prepared employer should be able to explain
The worker should not be left to join separate immigration, payroll and tax instructions after arrival.
Use the correct 2026 salary category
For applications from 1 June 2026, apply the revised Employment Pass bands and category conditions rather than an older guidebook table.
File through the company account
The individual cannot self-file an Employment Pass. The employer must be registered and supply the role and company evidence.
Run tax payroll
HASiL requires employer registration, monthly tax deductions where applicable and notification of a new taxable employee through e-CP22 within the stated period.
Manage changes and departure
Use the current shortening, cancellation and change processes; coordinate tax-clearance duties and final payment when the employee leaves.
Important: A work permit is not a tax ruling. Where duties are performed, days present, who pays and which entity receives the benefit can all matter.
If the job changes or ends
Plan the exit before the first day of work
A job-linked permission can affect the worker, the employer and family members whose residence depends on the principal.
- 1Employer + worker
Agree the employment end
Record the final date, final pay, notice, benefits and whether the employee will remain in Malaysia for a new role or depart.
- 2Employer
Shorten or cancel the pass
Use ESD's current online or prescribed process. Do not assume the ePASS remains usable until its printed expiry after the job ends.
- 3Payroll
Handle tax clearance
Depending on the case, the employer may need to notify HASiL, withhold money and wait for tax clearance before releasing final sums.
- 4Family
Rebuild the family status
A new employer requires a new application, and linked dependant passes may need fresh sponsorship, shortening or re-endorsement.

Common questions
Questions about work permits and working in Malaysia
Does a residence visa let me work in Malaysia?
Not automatically. Immigration permission to stay and legal permission to perform a particular job or business activity are separate questions. Some routes combine them, some require an additional permit, and family or visitor status usually needs a separate work check.
Can my spouse work on a dependant pass?
Do not assume so. A dependant may need their own employer-sponsored status, work permit or formal variation before starting. Ask the employer to identify the exact authority, category and approval in writing—not simply say that the family visa is valid.
Does being paid overseas mean local work rules do not apply?
No. Authorities can look at where the person is physically working, who benefits from the work and what the immigration category permits. Overseas payroll also does not settle personal tax, employer payroll, social-security or corporate-presence questions.
Can I invoice clients or run my own company?
Only after checking both the person's activity and the business vehicle. Company registration, foreign-ownership approval and immigration permission solve different parts of the problem. Owning shares does not automatically authorise day-to-day work for the company.
Do professional qualifications transfer automatically?
Usually not for regulated work. Healthcare, education, engineering, architecture, law, accountancy and other professions may require recognition, registration, a temporary permit or local-language evidence before work authorisation can be completed.
Who should pay government work-permit costs?
Ask the employer to set out government fees, required employer contributions, professional fees and any lawful employee costs separately. Do not pay an intermediary against a vague promise of a job or permit, and obtain receipts from the official process.
What should happen if my employment ends?
The employer and worker may both have time-sensitive notification, cancellation, tax-clearance and immigration steps. Linked family status may also be affected. Ask for the exit sequence before signing the contract, not during the final week of employment.
How often should I recheck this information?
SettleHappy reviews these pages every 90 days and after major official announcements. You should still verify the live rules when an offer is made, before an application is filed and again before anyone starts work, because procedures can change between editorial reviews.
What are Malaysia's Employment Pass salary bands from 1 June 2026?
The revised policy sets Category III at RM5,000–RM9,999 a month, Category II at RM10,000–RM19,999 and Category I at RM20,000 or more. Category and possible duration still depend on approval and other conditions, so use the live ESD policy for the application.
Can I apply for my own Malaysian Employment Pass?
No. ESD states that expatriates do not apply for their own passes; the company intending to hire the expatriate must register and submit the application.
